Welcome to Trusted: Track Debt & Payday. These Terms of Use ("Terms") govern your access to and use of the Trusted: Track Debt & Payday mobile application (the "App") operated by Trusted Loan Partners LLC ("Company," "we," "us," or "our"). Please read these Terms carefully. By using the App, you confirm that you understand and agree to these Terms in full.

If you do not agree to these Terms, you must not access or use the App.

1. Acceptance of Terms

By accessing or using the App, you:

• Confirm that you are at least 18 years old and a legal resident of the United States;
  
• Agree to comply with all applicable local, state, and federal laws and regulations;
  
• Acknowledge that you have read, understood, and accepted these Terms;
  
• Affirm that you have the legal capacity to enter into a binding agreement;
  
• Accept full responsibility for any risk associated with using the App.
  

We may amend these Terms from time to time. Any material changes will be communicated through the App or via email. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

2. Description of Services

Trusted: Track Debt & Payday provides a matching platform that connects users with potential third-party lenders. We are not a lender, do not offer loans, do not make credit decisions, and do not participate in any financial transactions between users and lenders.

Our services include, but are not limited to:

• Collecting your information via a digital form;
  
• Matching you with third-party lenders based on the data you submit;
  
• Transmitting your information securely to potential lenders;
  
• Allowing you to review loan offers directly from lenders (if any).
  

We do not:

• Guarantee loan approval;
  
• Influence lender decisions or terms;
  
• Provide financial, legal, or credit advice;
  
• Participate in loan negotiations or agreements.
  

Any loan agreement entered into is solely between you and the lender. You are solely responsible for evaluating any lender offer.

3. User Eligibility & Accounts

To use the App, you must:

• Be at least 18 years old;
  
• Be a U.S. resident;
  
• Submit truthful, accurate, and current information.
  

If account registration becomes available, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately if you suspect unauthorized access.

We reserve the right to disable or delete any account at our sole discretion, especially if fraudulent activity or policy violations are suspected.

4. Loan Offers and Third-Party Lenders

The App facilitates connections between users and independent third-party lenders. We do not control, endorse, or guarantee any lender or loan product.

• We are not a broker or agent.
  
• We are not involved in loan underwriting, approval, or disbursement.
  
• We do not represent you or any lender in any transaction.
  

It is your responsibility to carefully review all loan terms before agreeing to any offer. If you choose to engage with a lender, your agreement will be subject to the lender’s own terms, policies, and applicable laws.

5. No Guarantee of Loan Approval

Submitting your information does not guarantee that:

• You will be matched with a lender;
  
• You will receive an offer;
  
• You will be approved for a loan;
  
• You will be offered specific terms, APRs, or amounts.
  

Lenders determine eligibility using their own criteria, which may include but is not limited to: credit score, income, employment status, residency, and debt-to-income ratio.

6. Fees and Charges

The App is free to use. We do not charge users any fees for submitting their information or accessing lender offers.

However, lenders may charge:

• Origination fees
  
• Late payment penalties
  
• Interest rates and other service charges
  

It is your responsibility to fully understand the loan terms, fees, and repayment conditions before accepting any offer. We are not responsible for any costs or penalties you may incur under your loan agreement.

7. User Conduct and Restrictions

By using the App, you agree not to:

• Provide false, inaccurate, or misleading information;
  
• Use the App for fraudulent, unlawful, or abusive purposes;
  
• Violate any applicable local, state, or federal laws;
  
• Attempt to gain unauthorized access to systems or user data;
  
• Interfere with or disrupt the App or servers.
  

Violation of these rules may result in the immediate suspension or permanent termination of access to the App and may subject you to civil and/or criminal liability.

8. Privacy Policy

Your use of the App is also subject to our Privacy Policy, which outlines how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

9. Disclaimer of Warranties

The App and all services are provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee that:

• The App will be uninterrupted or error-free;
  
• You will be matched with a lender;
  
• Any loan offers will meet your financial expectations.
  

We disclaim all liability related to third-party content, services, or offers made available through the App.

10. Limitation of Liability

To the fullest extent permitted by law, Trusted Loan Partners LLC shall not be liable for:

• Indirect, incidental, punitive, or consequential damages;
  
• Loss of data, income, profits, or business opportunities;
  
• Errors or omissions in any content or data;
  
• Actions or omissions of third-party lenders.
  

You use the App at your own risk.

11. Indemnification

You agree to indemnify, defend, and hold harmless Trusted Loan Partners LLC, its officers, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses arising out of or in connection with:

• Your use of the App;
  
• Your violation of these Terms;
  
• Your violation of any rights of another party.
  

12. Changes to These Terms

We may modify these Terms from time to time. Any changes will be effective when posted. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions.

Any dispute arising from your use of the App shall be submitted to binding arbitration in Boulder, Colorado, except where prohibited by law. You agree to waive any right to participate in class actions.
